Expert, aggressive defense of claims has been a hallmark of ISMIE since its inception. To proactively identify trends and changing conditions in the volatile
medical liability insurance market, ISMIE regularly analyzes claims frequency and severity statistics. In 2007, claims frequency continued to decrease, while the average claims payout continued its upward climb, hovering near the $600,000 level for most of the year (up from about $450,000 in January 2002).

In addition to monitoring the medical liability climate, ISMIE conducts an annual physician satisfaction survey to measure the effectiveness of the defense team for assisting policyholders confronted with lawsuits. This “yardstick” provides feedback that helps ISMIE to continue to meet or exceed physicians’ expectations for the best possible service during the stressful claims experience.

For the most recent survey, ISMIE received scores of 9.2 and above on a scale of zero to 10 for:

  • Knowledgeable, courteous and professional claims representatives.

  • Legal counsel’s ability to prepare an aggressive defense, adequately prep policyholders for testimony, and be accessible to the policyholder for fielding case-related questions.

Tools developed to combat claims
In 2007, an updated Claims Survival Kit was developed for any policyholder faced with a lawsuit. A new educational DVD, “How to Survive a Medical Liability Claim,” is a central part of the kit. This tool is designed to prepare physicians for each stage of the litigation process, from the summons and complaint through the resolution of the claim.

In 2008, the DVD was launched as a Risk Rewards learning activity, offering a premium discount and CME credit with successful completion of an online test.
