Responding to the IDPR and NPDB

When any payment is made by ISMIE on behalf of our insureds, ISMIE is required by federal and state laws to report that payment to both the Illinois Department of Professional Regulation (IDPR) and the National Practitioner Data Bank (NPDB).

Upon receipt of our report, IDPR will send the insured a certified letter requesting that they provide additional information regarding the incident. The information provided will be made part of the permanent record and may deter further investigation by the IDPR.

A RESPONSE TO IDPR IS MANDATORY

Pursuant to the mandatory reporting provisions within the Illinois Medical Practice Act of 1987, insureds are required to submit a written statement responding to IDPR inquiries. Failure to respond to these inquiries constitutes a potential violation of the Medical Practice Act and can result in a minimum fine of $1,000.00 and a requirement to appear before the Disciplinary Board.

The NPDB will also send a Practitioner Notification Document. The last page of this document affords the opportunity to make an unedited statement which will be added to the Data Bank report. The statement must be no more than 2,000 characters, and can be sent to the Data Bank at any time. While it is not mandatory to respond to the NPDB as it is with the IDPR, we encourage policyholders to add their personal statement to their NPDB record.
