In 1976, ISMIE’s founding year, caps were overturned when the Illinois Supreme Court found that the General Assembly could not limit both economic and non-economic damages. Twenty-one years later, caps were again struck down when the court held that the law wrongly applied to all tort cases, not just medical liability suits. The current reform law should stand as constitutionally valid, having addressed the previous issues.
