Is This the Last Straw(berry) for Frivolous Lawsuits?

A frosty consumer recently filed suit in a quest to get more strawberries loaded into her frosted strawberry Pop-Tarts.

The Kellogg pastry’s nutritional label clearly indicates that there are other fruits in the breakfast snack’s recipe with a splash of strawberry flavoring added. Despite the ingredients being printed on the box, it isn’t stopping a class action lawsuit arguing consumers have been duped! The claim is that the current strawberry ratio isn’t enough to provide the berry’s nutritional benefit and to elicit a strawberry taste.
 
If this lawsuit has a fishy familiarity it’s because a similar suit was filed in California earlier this year. In that case, the litigants claimed they weren’t getting enough tuna in Subway’s tuna sandwiches.
 
This is getting berry ridiculous
