Juries Continue to Award “Nuclear” Verdicts

October 29, 2024

In the closing months of 2024, the trend of significant verdicts in medical professional liability cases persists nationwide. ISMIE remains vigilant in tracking legal developments that impact the medical profession. Here are some recent court activities of note:

  • A Texas jury awarded $59.7 million to a Beaumont man who became paralyzed after alleged medical negligence.
  • In Pennsylvania, a jury awarded $24 million to a man injured during a spinal surgery procedure and another jury in that state awarded a woman $7 million following an alleged missed diagnosis by a radiologist that resulted in the patient’s blindness.
  • An Oregon jury awarded $24.6 million to the family of a patient who died during a colonoscopy procedure.

ISMIE continues to monitor cases nationally, as they serve as important reminders of the evolving landscape of medical professional liability and the necessity for robust risk management practices in healthcare.

For those impacted by lawsuits, whether now or in the future, ISMIE’s Litigation Stress Resource Center offers strategies that will help policyholders navigate or prepare for the psychological pressures often associated with being served with a lawsuit.
