Diagnostic Errors Top Reason for Lawsuits Against Radiologists

May 13, 2025

A recent analysis of thousands of medical liability cases against radiologists found the majority of lawsuits were filed because of diagnostic errors (83%). Most errors were made on mammograms (26.4%), followed by CT scans (23.3%) and X-rays (18.3%). The analysis also found procedural and communication errors but at much lower rates.

Many of the cases were resolved with out-of-court settlement or in judgements in favor of the defendant radiologists. However, for cases that involved a jury with trial decisions favoring the plaintiff, average financial awards were higher than out-of-court settlements.

Conducting, interpreting and communicating radiologic imaging, as well as performing interventional procedures, comes with the potential for a variety of risks.

ISMIE’s resource on radiology risk tips outlines key strategies to reduce risk before, during and after radiologic tests and procedures, along with the importance of having strong processes in place to ensure the patient has the highest quality of care possible.
